Harassment Policy

Northeast Data seeks to provide a work environment that is free from intimidation and harassment. Harassment and intimidation can arise from a broad range of physical or verbal behavior, which can include, but is not, limited to, the following:

Northeast Data prohibits any form of harassment relating to age, race, sex, sexual orientation, national origin, religion and the other protected categories by employees, co-workers and managers, and views such actions very seriously. Such harassment or similar unacceptable activities that could become a condition of employment or a basis for personnel decisions, or which create a hostile environment, are specifically prohibited.

Sexual harassment is a particular form of employee misconduct, which requires more explanation. All employees must be allowed to work in an environment free from unsolicited and unwelcome sexual overtures. Sexual harassment does not refer to occasional compliments or other generally acceptable social behavior. It refers to behavior that is not welcome, is personally offensive, undermines or weakens morale, and, therefore, unreasonably interferes with the work effectiveness of its victim and his/her co-workers. Sexual harassment may include such conduct as: (1) offensive, sex-oriented verbal “kidding”, jokes or abuse; (2) pressure for sexual activity; (3) offensive, unwanted physical contact such as patting, pinching or repeated brushing against another’s body; and (4) demands for sexual favors, accompanied by implied or overt promises for preferential treatment concerning an individual’s employment status.

The objective of this “no harassment” policy is to create a positive working environment, which is free from hostile, offensive, intimidating or harassing conduct that unreasonably interferes with any employee’s work due to any of the types of harassment described above. The target of this policy is the prevention of unwelcome conduct. Employees should be aware of any conduct on their part, which could be construed as welcoming conduct directed at them, which the employee might actually consider to be unwelcome.

In some situations, a person may not realize that his/her behavior is inappropriate or unwelcome. Employees who consider any person’s behavior to be inconsistent with these guidelines are encouraged to tell that person that his/her behavior is considered inappropriate and request that the conduct stop.

All forms of unlawful harassment are prohibited. If any employee becomes aware of any harassment, this information should be communicated – without fear of retaliation – to any manager at Northeast Data. Northeast Data strongly encourages such employees to come forward promptly. Timely reporting also discourages the spread of harmful rumors. Northeast Data will continue its practice of taking prompt and necessary steps to investigate and, where appropriate, correct any form of harassment.

Any employee found to be guilty of sexual harassment would be terminated immediately. No warnings will be given, verbal or written. Sexual harassment cases will be turned over to the proper law enforcement authorities and will be prosecuted to the fullest extent of the law.

Negative Behavior

Negativity comes from many different sources. Negative behavior manifests itself in several different ways: external and verbal. Northeast Data will not tolerate these types of negative behavior at any time.

External Behavior

External negative behavior such as backstabbing, rabble rousing or martyrdom will not be tolerated at Northeast Data. This type of negativity is very destructive. Any Northeast Data employee displaying External Negative Behavior toward others associated with the company will be:

Verbal Behavior

Verbal negative behavior such as Gossip, making cynical comments, and state apathetic comments will also not be tolerated at Northeast Data at any time. Any Northeast Data employee displaying Verbal Negative Behavior toward others associated with the company will be:

Discrimination and Harassment

Northeast Data is committed to providing equal employment opportunity and prohibits all forms of unlawful harassment and discrimination based upon race, color, religion, gender, national origin, ancestry, age, sexual orientation, veteran status, marital status, mental or physical disability, or any other basis protected by law. This policy applies to all areas of employment including, for example, recruitment, hiring, training, promotion, compensation and benefits. Employees may not discriminate against or harass any other employee, applicant, customer, vendor or visitor. This policy applies to all employees including non-supervisory personnel, managers and executives. It also applies to non-employees who have business contact with employees.

Any employee who is the subject of, who has knowledge of, or who witnesses any possible prohibited harassment or discrimination should immediately bring such information to the attention of any one or more of the following persons: his/her immediate department foreman or a representative of the Management Team. Northeast Data will continue its practice of taking prompt steps to investigate concerns regarding prohibited harassment and discrimination and where appropriate, take prompt corrective action. Northeast Data will handle reports of such alleged misconduct with sensitivity to concerns for confidentiality, reputation and privacy, as is practicable.

Employees may not take any kind of retaliatory action against an employee who has made a good faith complaint about harassment or discrimination prohibited by this policy. It is the responsibility of every employee of Northeast Data to follow this policy conscientiously.

Sexual Harassment

Northeast Data is committed to an environment, which encourages fair, humane, and beneficial treatment of all employees and customers. In accordance with that fundamental objective, Northeast Data has a continuing commitment to assure equal opportunity and to oppose discrimination because of race, color, sex, sexual orientation, age, religion, national origin, handicap, height, weight, or marital status. Therefore, in that same perspective, neither sexual harassment nor sexism will be tolerated behavior at Northeast Data. It is expected that each member of Northeast Data will consider himself/herself responsible for the proper observance of this policy.

Definitions:

Sexual Harassment: Sexual harassment is defined as unwelcome sexual conduct, which is related to any condition of employment. This definition is intended to include more than overt advances toward actual sexual relations. It applies as well to repeated or unwarranted sex-related statements, unwelcome touching, sexually explicit comments, and/or graphics. All persons should be sensitive to situations that may affect or cause the recipient discomfort or humiliation or may display a condescending sex-based attitude towards a person. Sexual harassment is illegal under both state and federal law. In some cases, it may be subject also to prosecution under the criminal sexual conduct law. Conduct will be defined as sexual harassment when any or all three of the following conditions exist:

Sexism: Sexism is defined as the perception and treatment of any person, not as an individual, but as a member of a category based on sex. Whether expressed in overt or subtle form such as sex-related jokes or materials, sexism in the classroom or workplace is unacceptable at Northeast Data and its elimination shall be the responsibility of the entire Northeast Data employees.

Depending upon the seriousness of the misconduct, informal corrective action may be adequate.

Complaint Procedure:

Sexual harassment and sexism constitute acts of misconduct. Therefore, whenever such acts are reported and confirmed, prompt disciplinary action will be taken, up to and including discharge. However, to enable Northeast Data to act through these formal procedures, employees are encouraged to report such incidents. Employees should report such conduct to the Northeast Data Operations Group.

The Operations Group shall establish appropriate procedures to implement this policy. The Operations Group shall also investigate thoroughly any complaints of alleged sexual harassment or sexism, and then report the results of such investigations to Sole Proprietor of Northeast Data.

*In cases of overt physical sexual contact, a blatant threat if sexual favors are not given, or promised reward in exchange for sexual favors, no notice that the conduct is unwelcome shall be necessary and a finding of sexual harassment may be based on a single occurrence.
