New Temporary Worker Onboarding

After a successful pre-screening and interview process has been completed by the Northeast Data Manager, the following must be completed:

A ten-year background check and 10-panel drug test must be completed.

Only after a clear background check and drug test, the applicant can then be offered temporary employment with Northeast Data.

Additionally, upon completion of the above, the staffing agency will ensure the temporary worker completes the below and provide signed copies / certificates to the Human Resources Department at Northeast Data, Inc.

Please note, only after operator proficiency aerial lift training is completed and certification processed with the Human Resources Department at Northeast Data, Inc. will a temporary worker be considered to operate an aerial lift. Online Lift certifications will not be accepted.

Baseline Audiogram Requirements

Once all paperwork is completed and processed by the Human Resources Department, then the applicant can be turned to “Temporary Employee Active Status” and can proceed to be assigned a work site.

Drug Testing

Temporary Employees subject to testing

Under Northeast Data’s drug and alcohol testing policy, current and prospective temporary employees who work or would work in high risk or safety sensitive positions will be asked to submit to drug and alcohol testing. No prospective temporary employee will be asked to submit to testing unless an offer of temporary employment has been made. An offer of Northeast Data, however, is conditioned on the prospective employee testing negative for drugs and alcohol.

Diluting / Substituting / Adulterating

Diluting / Substituting / Adulterating a urine sample is strictly prohibited. Any temporary employee found to have in their possession or has used in order to pass a drug test anything that will alter or has altered a urine sample will be terminated immediately.

Safeguards

Northeast Data’s policy is intended to comply with all state and federal laws governing drug and alcohol testing and is designed to safeguard temporary employee privacy rights to the fullest extent of the law.

Selection

Participants of the Northeast Data drug testing will be selected for any of the following reasons.

A. Pre-employment testing B. Reasonable suspicion
C. Random testing D. Post accident / injury testing

Notice

Any temporary employee selected for a random drug test will be given a 1-hour verbal notice to report to the drug testing facility. Any temporary employee failing to show up at the drug testing facility within the 1-hour limitation will be terminated from employment. Any temporary employee refusing to take the drug and/or alcohol test will be immediately terminated from employment.

Licensed Laboratories

A laboratory licensed by the state will conduct any drug and/or alcohol testing required or requested by Northeast Data. The Licensed Laboratory will give the employee a split specimen test. One portion of the sample will be sent for drug / alcohol testing and the other portion will be kept for retest on positive results.

Notice of Results

If the temporary employee is asked to submit to a drug or alcohol test, Northeast Data or staffing agency will notify the employee of the results within 72 hours after it receives them from the laboratory. To preserve the confidentiality Northeast Data strives to maintain, the employee will be notified by verbal notification in a confidential area as to whether the test was negative or confirmed positive and, if confirmed positive, what the next step is.

Positive Test Results

If the employer receives notice that the temporary employee's test results were confirmed positive, the temporary employee will be given the opportunity to explain the positive result following the employee's receipt of the test result. If the sample is confirmed positive once, an MRO (Medical Review Office) will complete a secondary test on the same sample. No full retests will be given for any confirmed positive test. The temporary employee who received the positive test will be immediately suspended from employment. The MRO will test the second split specimen. After that testing has been completed and results have come back to the office, Northeast Data will notify the temporary employee of termination or date of return to work depending on the outcome. A second positive test is grounds for immediate termination.

In addition, the temporary employee may have the same sample retested at a different laboratory of the temporary employee's choice. However, the temporary employee will pay the additional cost, not the employer.

Adverse Employment Action

If there is a reason to suspect that the temporary employee is working while under the influence of an illegal drug or alcohol, the temporary employee will be suspended without pay until the results of a drug and alcohol test are made available to Northeast Data by the testing laboratory. Where drug and alcohol testing is part of a routine physical or random screening, there will be no adverse employment action taken until the test results are in.

Confidentiality

Northeast Data will make every effort to keep the results of drug and alcohol tests confidential. Only persons with a need to know the results will have access to them. The temporary employee will be asked for consent before test results are released to anyone else. Be advised, however, that test results may be used in arbitration, administrative hearings and court cases arising as a result of the temporary employee's drug testing. Also, results will be sent to federal agencies as required by federal law. If the temporary employee is to be referred to a treatment facility for evaluation, the temporary employee's test results will also be made available to the temporary employee's counselor. The results of drug testing in the workplace will not be used against the temporary employee in any criminal prosecution.

Costs

Northeast Data or the Staffing Agency dependent on the staffing agreement on file, will pay the cost of any drug and alcohol testing that it requires or requests temporary employees submit to, including retesting of confirmed positive results. Any additional tests that the temporary employee requests, will be paid for by the temporary employee.

Drug and Alcohol Use at Work Prohibited

Northeast Data is a zero-tolerance company and will not tolerate any use of non-prescribed drugs or alcohol during working hours. If the temporary employee comes to work under the influence of drugs during working hours, the temporary employee will be terminated immediately. Any temporary employee under the influence of alcohol during work hours will be subjected to the alcohol progressive disciplinary program.

Violation of Policy

It is a violation of company policy for any employee to sell, purchase, use, consume, possess, manufacture, distribute, dispense, or transport any illegal substance, or to abuse any controlled substance, on company premises and at any time during working hours, including meal and break periods. Company employees shall report to work with their abilities unimpaired by illegal or controlled substances, and remain so throughout their assigned workday.

If you are convicted of a violation of any criminal drug statute, and that violation occurred in the workplace, you are required to notify your manager within five (5) days after such conviction. Conviction; means a finding of guilt or acceptance of a guilty plea, including a plea of nolo contendere, or imposition of a sentence, or both, by a judicial body.

If you violate this policy, you will be immediately discharged.

Company Vehicles

The consumption of alcohol is forbidden at any time an employee is on the clock or driving a company provided vehicle. No alcohol will be transported / consumed when riding in any company vehicle. Any employee who is found under the influence while driving a company provided vehicle, even if the consumption was completed prior to or while driving the company provided vehicle, the employee will be immediately terminated.
