Under Northeast Data’s drug and alcohol testing policy, current and prospective employees who work or would work in high risk or safety sensitive positions will be asked to submit to drug and alcohol testing. No prospective employee will be asked to submit to testing unless an offer of employment has been made. An offer of Northeast Data, however, is conditioned on the prospective employee testing negative for drugs and alcohol.
Diluting / Substituting / Adulterating a urine sample is strictly prohibited. Any employee found to have in their possession or has used in order to pass a drug test anything that will alter or has altered a urine sample will be terminated immediately.
Northeast Data’s policy is intended to comply with all state and federal laws governing drug and alcohol testing and is designed to safeguard employee privacy rights to the fullest extent of the law.
Participants of the Northeast Data drug testing will be selected for any of the following reasons.

Any employee selected for a random drug test will be given a 1 hour verbal notice to report to the drug testing facility. Any employee failing to show up at the drug testing facility with in the 1 hour limitation will be terminated from employment. Any employee refusing to take the drug and/or alcohol test will be immediately terminated from employment.
Licensed Laboratories
A laboratory licensed by the state will conduct any drug and/or alcohol testing required or requested by Northeast Data. The Licensed Laboratory will give the employee a split specimen test. One portion of the sample will be sent for drug / alcohol testing and the other portion will be kept for retest on positive results.
If the employee is asked to submit to a drug or alcohol test, Northeast Data will notify the employee of the results within 72 hours after it receives them from the laboratory. To preserve the confidentiality Northeast Data strives to maintain, the employee will be notified by verbal notification in a confidential area as to whether the test was negative or confirmed positive and, if confirmed positive, what the next step is.
If the employer receives notice that the employee's test results were confirmed positive, the employee will be given the opportunity to explain the positive result following the employee's receipt of the test result. If the sample is confirmed positive once, a MRO (Medical Review Office) will complete a secondary test on the same sample. No full retests will be given for any confirmed positive test. The employee of the positive test will be immediately suspended from employment. The MRO will test the second split specimen. After that testing has been completed and results have come back to the office, Northeast Data will notify the employee of termination or date of return to work depending on the outcome. A second positive test is grounds for immediate termination.
In addition, the employee may have the same sample retested at a different laboratory of the employee's choice. However, the employee will pay the additional cost not the employer.
If there is a reason to suspect that the employee is working while under the influence of an illegal drug or alcohol, the employee will be suspended without pay until the results of a drug and alcohol test are made available to Northeast Data by the testing laboratory. Where drug and alcohol testing is part of a routine physical or random screening, there will be no adverse employment action taken until the test results are in.
Northeast Data will make every effort to keep the results of drug and alcohol tests confidential. Only persons with a need to know the results will have access to them. The employee will be asked for the employee's consent before test results are released to anyone else. Be advised, however, that test results may be used in arbitration, administrative hearings and court cases arising as a result of the employee''s drug testing. Also, results will be sent to federal agencies as required by federal law. If the employee is to be referred to a treatment facility for evaluation, the employee's test results will also be made available to the employee's counselor. The results of drug testing in the workplace will not be used against the employee in any criminal prosecution.
Northeast Data will pay the cost of any drug and alcohol testing that it requires or requests employees submit to, including retesting of confirmed positive results. Any additional tests that the employee requests, will be paid for by the employee.
Northeast Data is a zero tolerance company and will not tolerate any use of non-prescribed drugs or alcohol during working hours. If the employee comes to work under the influence of drugs during working hours, the employee will be terminated immediately. Any employee under the influence of alcohol during work hours will be subjected to teh alcohol progressive disciplinary program.
It is a violation of company policy for any employee to sell, purchase, use, consume, possess, manufacture, distribute, dispense or transport any illegal substance, or to abuse any controlled substance, on company premises and at any time during working hours, including meal and break periods. Company employees shall report to work with their abilities unimpaired by illegal or controlled substances, and remain so throughout their assigned workday.
If you are convicted of a violation of any criminal drug statute, and that violation occurred in the workplace, you are required to notify your manager within five (5) days after such conviction. Conviction; means a finding of guilt or acceptance of a guilty plea, including a plea of nolo contendere, or imposition of a sentence, or both, by a judicial body.
If you violate this policy, you will be immediately discharge.
The consumption of alcohol is forbidden at any time an employee is on the clock or driving a company provided vehicle. No alcohol will be transported / consumed when riding in any company vehicle. Any employee who is found under the influence while driving a company provided vehicle, even if the consumption was completed prior to or while driving the company provided vehicle, the employee will be immediately terminated.

Northeast Data, Inc. recognizes that alcohol abuse has an impact, not only on a person's health, but also on the level of productivity and ability to perform his or her professional responsibilities. We are concerned about each person's safety and general state of health and are committed to providing a safe environment that is free from the harmful effects of alcohol and drugs. We also strive for the highest quality service and work product for our clients, which requires us to think clearly, be alert, and work at our most capable level. For these reasons, Northeast Data, Inc. has developed guidelines concerning the use of alcohol that apply to all staff.
Northeast Data is a ZERO Tolerance company. Northeast Data's company policy, maintains that no alcohol will be consumed when riding in any company owned vehicle by the driver, or any persons riding in the vehicle. No open ** alcohol containers are permitted at any time within a company owned vehicle. No alcohol containers (open / closed / full / or empty) / cartons are permitted within a company owned vehicle at any time, while that vehicle is at a customer site location. It is the driver's responsibility to ensure this policy is strictly enforced, and will be the responsible party if containers are found as described above. Anyone who has been convicted of DUI/DWI and / or is found under the influence while driving a company owned vehicle will be subject to immediate termination from employment. Northeast Data reserves the right to disregard any and all warning procedures used in the employee termination process in all DUI/DWI violations.
** An Alcohol Container is any vessel marked or unmarked that can contain any form of Alcohol (ie beer can / wine bottle / soda bottle / flask / cup / etc)
Any Employee convicted of DUI/DWI while operating a company owned vehicle is required to notify your manager immediately after such conviction. "Conviction" means a finding of guilt or acceptance of a guilty plea, including a plea of nolo contendere, or imposition of a sentence, or both, by a judicial body.
After hours dinners and sports activities with clients may be occasions when it is acceptable for Northeast Data staff to have one or two drinks. Because alcohol affects people differently, each person should exercise judgment and moderation.; If a client becomes affected by alcohol consumption, he or she should be driven home by someone who has not been drinking or taken home by taxi.
Northeast Data may on occasion sponsor a company picnic, holiday party, or party for clients. These events are offered for a variety of purposes; to get to know each other on a social level, or just relax and show our appreciation for our clients and employees that work for Northeast Data, Inc. The decision on whether to offer alcoholic beverages is the responsibility of the President of Northeast Data, Inc. When alcoholic beverages are offered, the hours of the event will be limited, and clients and employees who seem to be affected should be driven home by someone who has not been drinking or encouraged to take a taxi at Northeast Data''s expense. It is not necessary always to offer alcoholic beverages at social events, and other alternatives, should be considered.
At no time, other than Northeast Data sponsored events, Northeast Data management approved events, or approved formal meetings / dinner with a client of Northeast Data are Northeast Data logoed Uniforms / wear to be worn within an Alcohol Furnishing Establishment / Environment. Anyone found to be non-compliant with this policy will be subject to the Northeast Data progressive discipline policy.
We encourage individuals who have a substance abuse problem or believe they are developing a problem that is affecting their performance or health to get medical advice, or seek confidential contact with HR, who will refer them to a treatment program that specializes in substance abuse.
Northeast Data's staff is assured that an individual's job security or promotion opportunities will not be jeopardized by the request for counseling and referral. Referral for counseling services may be requested by the employee, or by the manager on behalf of the employee, on the basis of unsatisfactory job performance. If treatment or counseling is suggested, the individual is expected to comply with the recommendation or will be subject to the progressive discipline policy.
Employees will be subjected to a Breath Alcohol test which will correspond with the time they take their random drug testing. Northeast Data will not tolerate any employee being under the influence of alcohol during work hours.
